Three Officers Ordered to Face New Trials in Death of Tyre Nichols

Judge Orders New Trials After Questions of Bias

Three former Memphis police officers convicted in the federal trial over the death of Tyre Nichols will receive new trials, a U.S. judge ruled Thursday.

Chief District Judge Sheryl Lipman found that comments attributed to U.S. District Judge Mark Norris, who presided over the 2024 federal case, created an “appearance of judicial bias.” Although she found no direct evidence of prejudice during the trial, Lipman said the Constitution requires not only the absence of actual bias but also the absence of even the appearance of it.

“The risk of bias here is too high to be constitutionally tolerable,” Lipman wrote in her decision.

Alleged Comments Spark Concerns of Fairness

According to court documents, Norris allegedly remarked that the Memphis Police Department was “infiltrated to the top with gang members” after his law clerk was shot during a carjacking—just days after the jury convicted the officers. He later recused himself from sentencing.

Defense attorneys argued that such comments raised serious concerns about fairness. “I think Judge Lipman did the right thing,” said Martin Zummach, who represents Justin Smith. “I immediately said, ‘We have to get a new trial. That’s the only right thing to do.’”

Nichols’ Death and Charges Against Officers

Tyre Nichols, 29, died three days after being brutally beaten by Memphis police during a Jan. 7, 2023, traffic stop. Video footage showed officers punching, kicking, and striking Nichols with a baton as he attempted to comply with chaotic commands.

In 2024, a federal jury convicted:

  • Demetrius Haley: Two counts of deprivation of rights resulting in bodily injury, two counts of tampering with a witness.
  • Justin Smith and Tadarrius Bean: One count each of tampering with a witness.

The men were acquitted on state charges earlier this year.

Two other former officers, Emmitt Martin and Desmond Mills, pleaded guilty to federal charges and await sentencing.

What’s Next

With new trials now ordered, Bean, Haley, and Smith will not face the most serious charges again due to acquittals on those counts. However, the upcoming proceedings will revisit the tampering charges tied to Nichols’ death.

Nichols’ killing sparked national outrage and renewed calls for police reform. His family, alongside community activists, continue to demand accountability in the case.
