Trump Team Considers Legal Action for Military Officers Involved in Afghanistan Withdrawal

The Trump transition team is reportedly compiling a list of senior current and former U.S. military officers involved in the chaotic U.S. withdrawal from Afghanistan. The team is exploring the possibility of court-martials for those officers, according to sources familiar with the plan. This follows criticism of both the Trump and Biden administrations for the handling of the withdrawal, which independent reviews have blamed for its disorderly execution.

Investigating Possible Legal Consequences

The investigation, led by Matt Flynn, a former deputy assistant secretary of defense, is focused on military officers involved in the decision-making process during the withdrawal. Flynn’s team is looking at whether these officers could face charges as severe as treason. However, it’s unclear what legal grounds would justify such charges, as the officers were following the orders of President Joe Biden to withdraw U.S. forces from Afghanistan.

The Chaotic Withdrawal and Its Aftermath

The U.S. withdrawal, completed under the Biden administration in 2021, followed a deal that former President Trump made with the Taliban in 2020. The deal called for the removal of about 13,000 U.S. troops and the release of 5,000 Taliban fighters from prison. While the Trump administration initiated the process, it was the Biden administration that ultimately oversaw its chaotic execution.

A 2022 independent review by the Special Inspector General for Afghanistan Reconstruction attributed blame to both administrations for the disorderly exit. Among the most criticized moments was the deadly attack at Abbey Gate, which killed 13 U.S. service members and over 170 Afghan civilians. Another controversial incident was a U.S. airstrike in Kabul, intended to eliminate an ISIS leader, which instead killed 10 innocent Afghan civilians, including seven children.

Trump’s Criticism of the Withdrawal

Former President Trump has strongly condemned the withdrawal, calling it a “humiliation” and “the most embarrassing day in the history of our country.” His pick for secretary of defense, Fox News personality Pete Hegseth, has also harshly criticized the handling of the exit. Hegseth, in his book The War on Warriors, called for a complete overhaul of Pentagon leadership, emphasizing the need to hold military leaders accountable for their failures in Afghanistan.

A Call for Accountability

The Trump transition team is reportedly considering the creation of a commission to investigate the decision-making process behind the withdrawal, including evaluating the responsibility of military leaders. Flynn and others involved in the transition are pushing for greater accountability, with some hoping to recall senior commanders to active duty for possible charges, though it remains uncertain what legal actions will be pursued.

While the exact charges the Trump team may pursue remain unclear, sources suggest that the focus could be on lesser charges aimed at setting an example for accountability in military leadership. As the investigation continues, the question remains whether those involved in the Afghanistan withdrawal will face legal consequences for their roles in one of the most criticized military operations in recent history.
