D10 Councilman Clayton Perry’s DWI Gets Probation in Hit-And-Run

District 10 Councilman Clayton Perry received 1 year of probation for his November 6, 2022 drunk driving that ended up with a hit-and-run.  Perry pleaded no contest for his drunkenness that ended in a hit-and-run.  This incident, by law, will only garner probation as he was charged with a Class B Misdemeanor and it was his first offense.  

David Christian was Perry’s attorney and the only one on Perry’s side in the courtroom. “Super sorry to the people who were in the accident, thank god nobody was hurt . the system has played out, we’ve kinda expedited the process,” says Christian outside the courtroom.

Clayton Perry stated, “I take full responsibility, I have done everything I can to make this right.”

Less than 5 months after this incident the plea deal came.  Perry had fled the scene that night and left no information behind.  He was later discovered by an Officer in his own backyard.  Perry was slurring words, very incoherent and couldn’t find out how to get into his own home. After more investigation Perry was found to have had 14 drinks that night, yes 14 and still decided to get behind the wheel.

The Judge’s decision was explained by Perry’s Attorney- David Christian:

“It’s one year probation, no drinking alcohol at all for the entire year , 48 hours of community service , he’s been given some credit because he’s an honorable discharged veteran , device on car for at least half the term ,” says Christian.

Here is what the prosecutor included in Perry’s sentence: educate Veterans about his journey, 1 year probation, no drinking alcohol for 1 year, 48 hours of community service (ONE WEEK MAYBE), half his probation will also include a device on his car.

“We asked for a conviction, obviously in our offer, but the court chose not to,” stated Prosecuting attorney with the Bexar County District Attorney’s Office Tamara Strauch.

Strauch explained that Perry’s, being on the city council, did not entitle him to any special treatment.

“We considered all of the evidence, the videos , we asked the court to place him on probation with a conviction , I believe it was a fair offer,” says Strauch.

If Clayton Perry can complete his probation successfully then charges would be dismissed but not expunged. If Perry does not complete probation successfully then there will be a motion to revoke and a warrant would go out for his arrest.
