Propositions – Understanding Their Relevance to Your Vote

Voting On Constitutional Amendments – November 7, 2023

As the calendar continues moving forward, we continue assessing what voters will be voting on in the upcoming election.

Proposition 1:

A constitutional amendment protecting the right to engage in farming, ranching, timber production, horticulture and wildlife management.

What it means:

The above rights will be protected “on real property that a person owns or leases.” It would not affect the legislative authorization of regulation of these practices, by state agencies or political subdivisions, to protect public safety or health from imminent danger; to prevent danger to animal health or crop production; or to preserve or conserve the natural resources of the state under the Texas Constitution. Additionally, the proposed amendment would not affect the legislature’s authority to authorize the use or acquisition of property for public use, including the development of natural resources under the Texas Constitution.

Proposition 2:

A constitutional amendment authorizing a local option exemption from ad valorem taxation, by a county or municipality, of all or part of the appraised value of real property used to operate a child – care facility.

What it means: 

This amendment proposes to allow the governing body of a county or municipality to adopt the exemption as a percentage of the appraised value of the property, but, that percentage could not be less than 50% of the appraised value of the property. The proposed amendment would allow the legislature to define the term “child – care facility” and to establish additional eligibility requirements to receive the property tax exemption.

Proposition 3:

Proposes a constitutional amendment to prohibit the legislature from imposing a tax based on the wealth or net worth of an individual or family. The proposed amendment also would prohibit the legislature from imposing a tax based on the difference between the assets and liabilities of an individual or family.

What it means:

This amendment would prohibit the state from implementing a wealth tax on the net value of someone’s assets.

Proposition 5:

A constitutional amendment relating to the Texas University Fund, which provides funding to certain institutions if higher education, to achieve national prominence as major research universities and drive the state economy.

What it means: 

This amendment would replace the National Research University Fund with two new funds: 

– The Texas University Fund and the National Research Support Fund.

– The Texas University Fund would support Texas State University, Texas Tech University, the University of Houston and the University of North Texas.

– The National Research Support Fund would support the University of Texas Arlington, the University of Texas Dallas and the University of Texas San Antonio.

Proposition 6: 

A constitutional amendment creating the Texas Water Fund, to assist in financing water projects in the state.

What it means: 

This amendment would create a state water fund. The fund would be administered by the Texas Water Development Board, which is responsible for meeting state water needs. The funds would be used for grants and low – interest loans to water projects across Texas.
