Special counsel Jack Smith has officially resigned from his post at the Justice Department, marking the conclusion of his investigation into President-elect Donald Trump. This move comes after Smith submitted his investigative report, which is at the center of ongoing legal battles regarding its public release.

Smith’s Resignation and the Trump Investigations

Smith’s resignation, disclosed in a court filing on Saturday, occurred one day earlier, just 10 days before Trump’s inauguration. This follows the conclusion of two criminal cases against Trump, which were withdrawn after his election victory in November. Smith’s report covers two major investigations: Trump’s alleged efforts to overturn the 2020 election results and his mishandling of classified documents at his Mar-a-Lago estate.

Legal Challenges Over the Report’s Release

The report’s release has become a point of contention. The Justice Department had planned to make the report public before the end of the Biden administration, but a judge appointed by Trump temporarily halted its release. The judge’s decision followed a request from Trump’s co-defendants, including his valet Walt Nauta and Mar-a-Lago property manager Carlos De Oliveira, who argued that disclosing the report would unfairly harm their cases. The Justice Department has complied by withholding the portion of the report related to classified documents until the cases against Nauta and De Oliveira are resolved.

Appeals Court Weighs In on Election Interference Report

While the classified documents portion remains under wraps, an appeals court recently ruled in favor of releasing the section concerning Trump’s efforts to interfere with the 2020 election. The report outlines his actions before the January 6, 2021, Capitol riot. However, U.S. District Judge Aileen Cannon issued an injunction preventing the release of the findings until a final resolution in the appeals court.

In response, the Justice Department filed an emergency motion on Friday, requesting the appeals court lift the injunction imposed by Judge Cannon. The department argued that Cannon’s order was flawed and that the Attorney General has the authority to determine whether to release the report.

Department of Justice’s Position on Report Release

The Justice Department emphasized that it is routine for special counsels to produce public reports, regardless of the subject. Both former Attorney General William Barr and current Attorney General Merrick Garland have released similar reports from previous special counsels. The department is now pushing for the timely release of Smith’s report, particularly the section detailing Trump’s election interference efforts.
